PERMIT ISSUANCE

The Agency issues permits (special license, license and/or approval) for the provision of postal services, pursuant to the Law on Postal Services. 

  • special license is a permit issued to a public postal operator for the provision of universal postal service;            
  • license is a permit issued to a postal operator for the provision of universal postal service other than reserved postal services;                
  • approval is a permit issued to a postal operator for the provision of other postal services.


The application for the license/approval must be submitted on the form prescribed by the Agency, containing the following mandatory information:

  1. basic information about the applicant, namely: business name, seat/registered office, postal mailing address, tax identification number (TIN), company registration number, current account number and bank identification number (BIN), telephone/telefax number, contact for users’ complaints, email address, company website;
  2. information for permit issuance, namely:
    • specification of postal services provided under the specific type of permit;
    • territory in which postal services are provided;
    • time period for which the permit is requested;
    • date of commencement of the provision of postal services;
  3. evidence on the following mandatory annexes to the application:
    • proof of fulfillment of the conditions for the provision of universal postal service in the entire territory of the Republic of Serbia;
    • general terms and conditions for the provision of postal services;
    • price list of postal services;
    • decision on the applicant’s identification mark;
    • authorization for signing of application.

A permit can be amended by submitting a Request for amendment of permit for the provision of postal services, along with the fulfilment of legal requirements.

The postal operator shall, in that case, submit an Application for amended permit (special license/ license/ approval) for the provision of postal services, containing:

  1. basic information about the applicant, namely: business name, seat/registered office, number and type of permit and postal mailing address;
  2. information regarding permit amendment: reason for permit amendment, planned date of permit amendment and a field for remarks;
  3. information about legal representative/ authorized person, namely: first and last name, position of employment, Unique Master Citizen Number, address, telephone/fax number, email address;
  4. authorization for signing of application.

Application for amended permit (special license/ license/ approval) for the provision of postal services

Along with the application form, the following mandatory annexes must be enclosed:

  • proof of business activity registration;
  • proof of fulfilment of requirements for commencement of business activity, provided by the competent authority;
  • general terms and conditions for the provision of postal services;
  • other supporing evidence provided for by law.

The Agency is obliged to decide on a regular application for the permit within 30 days from the day of submission of the application. In the event of deadline not being met, the permit shall be considered granted the next day after the expiration of that period.

The permit shall include the following information:

  • specification of postal services;
  • territory in which postal services are provided;
  • term validity of the permit and date of commencement of the provision of postal services;
  • permit issuance fee and payment deadline.

Postal operators shall pay the Agency the cost of the permit issuance fee in the amount of 18,200.00 RSD, as well as an annual fee in the amount of 0.4% of the total revenue generated from the provision of postal services.

The special license shall be issued for a term of 15 years.

The license shall be issued for a term of 10 years.

The approval shall be issued for a term of one to ten years, in accordance with the application.

The permit user may stop using the permit even before the expiry of the period for which the permit was issued. In that case, the permit user shall notify the Agency of the cessation of the use of the permit within 30 days prior to the cessation of the activity and settle all assumed obligations towards the users, the Agency and other persons.

The permit is non-transferable.

The permit may be revoked for any of the following reasons:

  • if obtained on the basis of false information, which was of importance for making the decision;
  • if postal services are not provided in accordance with the law, in the manner and under the conditions determined by the permit;
  • if damage to the general interest or damage on a large scale has been caused by unlawful pursuit of an activity;
  • if the permit user did not start providing postal services within 30 days from the day of obtaining the permit or there was a break in the provision of postal services for a continuous duration of more than 12 months;
  • if the permit user did not settle the obligation of paying the operational costs fee to the Agency, stipulated under the law governing the postal services.

In the above cases, the Agency shall determine the manner of settling the obligations of the permit user toward the users of postal services and/or the Agency, and decide on handling of postal items.

The Agency makes decisions in accordance with the provisions of the law governing the general administrative procedure. The decisions of the Agency referred to in paragraph 2 of this Article shall be final and an administrative dispute may be brought against them before the Administrative Court.
